Mission of Role
The organization has ambitious growth plans and as a senior member of the Legal and Compliance Team the incumbent is a key member of the extended leadership team to support the growth plans
Role Responsibilities
India remains a highly complex and regulated environment for alcohol producers with significant associated risk. She/he will be responsible to:
- Manage the process, negotiation, drafting and monitoring of legal documents involving the India entity
- Manage dispute procedures, including litigation and pre-litigation claims, negotiations, arbitration, mediation and other forms of dispute resolution
- Provide overall legal support to the Supply Chain team including legal advice on footprint expansion, product regulation, environmental, and health/safety issues involving the plants, in coordination with internal and external regulatory experts
- Strong and proactive partnerships with all external stakeholders- industry associations, regulators
- Advisory on all company matters including but not limited to HR matters, labour complaints, banking matters and applicable statutory laws. To be part of RCC Committee and updating the members regarding ongoing risk matters impacting the company
- Preparing relevant documents for statutory authorities relating to the alco-bev industry and appearing in meetings before such authorities. Dealing with the state excise authorities in several matters including the approval of labels and replying to the state excise authority on frequent basis i.e. alleging the non-compliance of laws, price increase etc
- Independently handling of the regulatory matters for the company relating to alcobev industry, including but not limited to FSSAI, Legal Metrology, excise laws, customs, etc
- Liaising and Coordination with various statutory authorities like RBI, State Excise, CESTAT, Custom Tribunal, Officer of Legal Metrology, Officer of FSSAI, Banks, Financial Institutions, Local Authorities, etc
- Responsible for handling ongoing customs and excise matters
- Playing a key role in annual project of label registration, reviewing the excise policies, providing of all legal documents for applying the label registration of 33 states/UT i.e. MOA, AOA, Authorization letters, list of directors, Board resolution, Power of attorney, FSSAI certificate, Affidavits, Undertaking, etc
- Responsible for advising the business on State Excise laws on suspension of licenses, route to market, marketing activities in various states etc
- Conducting and framing trainings on applicable Anti-corruption laws FCPA, Anti-money Laundering, Antitrust, Code of Conduct and Prevention of Sexual Harassment
Qualifications & Experience
- Minimum 8+ yrs experience
- LLB
- In-depth understanding of the alco-bev industry
- Travel 30-40 % mainly domestic but some international travel may be required
- Excellent oral and written communication skills
- Strong analytical & project management skills
- Experience working with a variety of stakeholders including the senior management and executive level
- Responsiveness and preference for fast moving environments. Orientation to results by keeping high working standards and achieving deadlines. Highly organized individual who knows how to establish priorities and drive teams to achievement.
- Ability to think strategically
- Communication and Presentation / Facilitation Skills (verbal & written): Effectively transfers thoughts and expresses ideas orally or verbally in individual or group situations. Ability to work with others even in virtual environment
